Donald Trump's historic victory in the U.S. presidential election raises deep questions about the fate of criminal cases against him, as his return to the White House provides potential legal protection, allowing him the opportunity to seek dismissal of charges or delay their resolution for years.
USA Today quoted legal experts confirming Trump's right to pardon himself, despite ongoing legal debate on this point, especially with his insistence on describing the prosecutions as "political."
Article Two of the U.S. Constitution grants the president authority to pardon federal crimes, while state cases remain outside his jurisdiction. Department of Justice documents issued in 2000 indicated the unconstitutionality of imprisoning a sitting president, considering it an obstacle to exercising executive power.
New York Judge Juan Merchan retains the right to proceed with Trump's trial in the Stormy Daniels payment case, with the possibility of reducing the sentence or postponing its implementation until the end of his presidential term. Legal experts told USA Today that it would be difficult to implement any punishment that conflicts with Trump's presidential duties, such as imprisonment.
The possibility of postponing Georgia state charges looms based on the Constitution's sovereignty clause, while a pardon from Republican Governor Brian Kemp remains a possible option. This unprecedented situation places the American judicial system before a historic challenge in balancing the principle of rule of law with the president's constitutional immunity.
